TERMS OF “FUELLING GENEROSITY” CAMPAIGN (“Terms”)
- APPLICABILITY
1.1. These Terms shall apply to the Fuelling Generosity campaign (the “Campaign”), which shall run from 16th February 2024 to 16th June 2024 (the “Term”).
1.2. These Terms will operate in addition to the general Terms and Conditions and Contest Terms linked here and on RaiseTogether’s website (“General Conditions”).
1.3. The Terms may be updated, amended or modified from time to time by RaiseTogether at our absolute discretion.
1.4. In the event there are any conflicts between any clauses in the General Conditions and these Terms, these Terms herein shall prevail. - PRIZE TERMS
2.1. The prize for the Campaign shall be a year’s supply of free fuel, which shall be limited to RM500 per calendar month (the “Prize”).
2.2. For the purposes of this Campaign, there shall only be one (1) winner, which shall be selected at random at the end of the Term.
2.3. RaiseTogether will notify the potential winner using the email address and phone number provided on RaiseTogether’s website.
2.4. The potential winner shall have 1 day to accept the Prize, before which RaiseTogether reserves the right to select a different participant as a winner (the “Winner”).
2.5. RaiseTogether shall provide the Winner with a fuel card which shall contain RM500 to be used at RaiseTogether’s partner fuel company (or companies). This fuel card shall be delivered to the address provided by the Winner on RaiseTogether’s website, or alternatively, to an alternative address which the Winner may provide when RaiseTogether notifies them in accordance with Clause 2.3.
2.6. On the 1st of every calendar month, RaiseTogether shall top up this fuel card to the value of RM500. In the event the Winner fails to fully utilise their monthly RM500 fuel allocation, the Winner shall waive their right to any unused sums, and RaiseTogether shall only be liable to top up the fuel card to the value of RM500.
To illustrate the operation of Clause 2.3 and 2.4, assuming:
i) The Winner only uses RM400 by the end of August 2024, leaving a remainder of RM100 for their monthly allowance; then
ii) On 1st September 2024, RaiseTogether shall top up RM400 into the fuel card, to bring the cumulative value loaded into the fuel card to RM500, which shall be the Winner’s fuel value for the month of September 2024. - SOCIAL MEDIA AND MARKETING
3.1. As a condition precedent to accepting the Prize for this Campaign, the Winner acknowledges, understands, and accepts to participate in the social media and marketing activities planned by RaiseTogether (the “Marketing Activities”).
3.2. The scope and extent of the Marketing Activities which the Winner may participate in includes, inter alia:
i) participating in a brief video recording conducted by RaiseTogether upon receiving the Prize. This video recording may include, but not be limited to, the Winner receiving the Prize, expressing their gratitude, and sharing their experience with the Campaign and the Prize (“Acceptance Footage”);
ii) recording themselves redeeming their prize. Winner acknowledges and agrees that any such footage created by Winner shall be voluntarily submitted to RaiseTogether for use on RaiseTogether’s social media platforms and marketing materials (“Winner-Generated Footage“); and
iii) with reasonable notice from RaiseTogether to the Winner, participating in any other video recording and/or interviews carried out by RaiseTogether in connection with the Campaign or Prize, which the Winner shall not unreasonably refuse (“Marketing Footage”).
(The Acceptance Footage, Winner-Generated Footage, and Marketing Footage shall collectively be referred to as the “Footage” from hereon)
3.3. The Winner hereby grants to RaiseTogether a non-exclusive, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works of the Footage recorded in accordance with Clause 3.2 above for promotional and marketing purposes in connection with RaiseTogether. This license shall continue in perpetuity. - WAIVER
4.1. The Winner hereby waives and releases RaiseTogether from any and all claims, demands, losses, liabilities, costs, and expenses arising out of or in connection with the use of the Footage in accordance with this clause. - REPRESENTATIONS, WARRANTIES AND INDEMNITIES
5.1. The Winner represents and warrants that they are the sole owner of all rights in and to the Winner-Generated Footage and that such footage does not infringe on the rights of any third party.
5.2. Winner agrees to indemnify and hold harmless RaiseTogether from any and all claims, demands, losses, liabilities, costs, and expenses arising out of or in connection with a breach of this warranty.
